Your access to and use of the Service is conditioned upon your acceptance of and compliance with these Terms. These Terms apply to all visitors, users, and clients who wish to access or use the Service. By accessing or using the Service, you agree to be bound by these Terms.
Punjab Tech provides a range of digital services including, but not limited to, website development, application development, Search Engine Optimization (SEO), App Store Optimization (ASO), AI and automation solutions, and digital marketing ("Services"). All services provided are subject to a separate agreement or statement of work that will detail the scope, deliverables, and fees.
As a client, you agree to:
Our IP: The Service and its original content (excluding content provided by clients), features, and functionality are and will remain the exclusive property of Punjab Tech and its licensors. Our trademarks and trade dress may not be used in connection with any product or service without the prior written consent of Punjab Tech.
Client IP: Upon full and final payment for the Services, we grant to you all rights, title, and interest in the final deliverables. We retain the right to use the deliverables for promotional purposes, such as in our portfolio.
Fees for our Services will be defined in a specific project proposal or service agreement. Unless otherwise stated, all fees are due as per the payment schedule outlined in said agreement. Late payments may result in suspension of work and/or incur late fees. All fees are non-refundable once work has commenced.
Both parties agree to treat all information shared during the course of the project as confidential. This includes business strategies, client lists, technical data, and project details. This information will not be disclosed to any third party without prior written consent, except as required by law.
In no event shall Punjab Tech, nor its directors, employees, partners, agents, suppliers, or affiliates, be liable for any indirect, incidental, special, consequential or punitive damages, including without limitation, loss of profits, data, use, goodwill, or other intangible losses, resulting from your use of our Services or any deliverables. Our total liability for any claim arising out of or relating to our Services shall not exceed the total fees paid by you to us for the Services in question.
Our services are provided on an "AS IS" and "AS AVAILABLE" basis. Punjab Tech makes no warranties, expressed or implied, and hereby disclaims all other warranties, including without limitation, implied warranties of merchantability, fitness for a particular purpose, or non-infringement of intellectual property.
We may terminate or suspend your access to our Service immediately, without prior notice or liability, under our sole discretion, for any reason whatsoever, including but not limited to a breach of the Terms. A client may terminate a service agreement as outlined in the specific project contract.
These Terms shall be governed and construed in accordance with the laws of India, without regard to its conflict of law provisions. Any legal action or proceeding arising under these Terms will be brought exclusively in the courts located in Chandigarh, India, and the parties hereby consent to the personal jurisdiction and venue therein.
We reserve the right, at our sole discretion, to modify or replace these Terms at any time. If a revision is material, we will provide at least 30 days' notice prior to any new terms taking effect. What constitutes a material change will be determined at our sole discretion.
